Regular Business Meeting June 5, 2023

REGULAR BUSINESS MEETING

JUNE 5, 2023

 

The President of the Council called the meeting to order at 6:30 p.m. The Pledge of Allegiance was stated by all present. The roll call was taken, Rob Lessen and Howard Camp were absent. Minutes from the previous meeting were presented. Gary Pommier made the motion to approve the minutes as presented. Richard Kerley seconds the motion. The motion was approved. The agenda was addressed. Prior to Unfinished Business Executive Session was added and under New Business Item G) Library, Pool Pass were added. Gary Pommier made the motion to approve the agenda as revised. Bob Lauck seconds the motion. The motion was approved. Appropriation Ordinance #5 was presented to the City Council. A few questions were asked and answered. Gary Pommier made the motion to approve Appropriation Ordinance #5. Richard Kerley seconds the motion. The motion was approved.

REPORTS

POLICE CHIEF

Report was submitted to the Council in their packets.

SUPERINTENDENT

Tom Gorman handed in his written report. Gary Pommier asked about the opening of N. West Street which Tom stated should be open by September 5th.

WEBSITE ADMINISTRATOR

Brie Wilson was present to report to the Council on how the city website operates and her need for a newer laptop to do her job.

EXECUTIVE SESSION

Gary Pommier made the motion to go into executive session for 5 minutes with the Council, Attorney and Clerk to discuss Attorney-Client issues. 6:50 p.m. Bob Lauck seconds the motion. The motion was approved.

Bob Lauck made the motion to go back into regular session at 6:55 p.m. Richard Kerley seconds the motion. The motion was approved.

UNFINISHED BUSINESS

WAYNE RONNING

Wayne reported on the property at W. Perry and N. 8th Street on the cleaning up of the property. Gary made the motion to open up negotiations with Wayne Ronning. Richard Kerley seconds the motion. The motion was approved.

GARY POMMIER; 69 HWY PROJECT

Gary Pommier made the motion to rescind the councils motion to approve the western corridor. Bob Lauck seconds the motion. Richard Kerley stated that this topic should be discussed with the full council present. The motion died due to a lack of a vote. Gary Pommier made the motion to table this issue until the next meeting. Richard Kerley seconds the motion. The motion was approved.

TEXTCASTER; BOB LAUCK

Bob stated that he was still in favor of implementing TextCaster into the city for informational reasons.

CAROL HARRYMAN N WEST ST PROJECT

Carol Harryman was present to discuss the access to her driveway on N. West St. Tom Gorman stated that he had spoken to KDOT about a type 2 laydown curb so that Carol can drive into the driveway. Tom also reported on the drainage and how water would disperse to the north.

CARMA BURNS; K.M.E.A.

Carma reported that Tyson McGreer will be at the July 5th council meeting to discuss the solar power idea.

JOELLEN BLACK, HOMECOMING

JoEllen reported on how Homecoming to setting up also asked the council to provide electricity at the park, portable toilets, bleachers, prepare hamburger stand and to have the road closures at 6th to 3rd and 5th to Main. The council agreed to handle JoEllen's request. City Clerk's office will also sell the arm bands prior to Homecoming.

NEW BUSINESS

KENNY HARRYMAN; NOISE ORDINANCE Kenny Harryman handed out copies of the City Ordinance #631 on noise pollution. Tom Hayes stated that he should do some research on case laws and report back to the council at the next meeting.

CERTIFICATE OF DEPOSIT

Two bids were received. Girard National Bank for 2.25% and Community National Bank for 4.15%. Gary Pommier made the motion to accept Community National Bank's bid. Richard Kerley seconds the motion. The motion was approved.

CARMA BURNS; JULY 3RD MEETING

Carma stated that the 4th of July is on a Tuesday this year and as of this point the city meeting is scheduled for the 3rd. Carma would prefer to first move the meeting to July 5th. Bob Lauck made the motion to move the first meeting in July to the 5th plus having Tyson McGreer join us on the 5th who is with KMEA. Gary Pommier seconds the motion. The motion was approved. It was also reported to the council that the City Court was moved to July 10th. Richard Kerley made the motion to approve this move. Gary Pommier seconds the motion. The motion was approved.

Carma then addressed the Tuesday holiday, and it would be nice if the council gave the city employees the Monday before the holiday off with pay. Richard Kerley made the motion to give the city employees Monday and Tuesday off with pay. Gary Pommier seconds the motion. The motion was approved by the council. Gary Pommier made an amendment to the above motion that the Police Dept. employees working would receive the extra pay or if they choose, they could receive 8 hours comp time. Richard Kerley seconds the motion. The motion was approved.

CARMA BURNS, LEAGUE OF KS. MUNICIPALITIES ANNUAL MEETING

Carma brought up attending this year's annual meeting in Wichita. The dates are 7th through the 9th, and she would like to have Tom Gorman and Chuck Burns attend the Trade Show during the Conference. Carma also asked if she could stay 3 nights instead of two due to driving time. Gary Pommier made the motion to send Carma along with Tom and Chuck to the Conference and Trade Show. Richard Kerley seconds the motion. The motion was approved.

GRASS CUTTING PENALTY

Bette Lessen reported to the City Council that letters have been sent out to residents who have not cut their yards. The Ordinance is sent with the letter and in the current Ordinance #535 there is no mention of a penalty being applied which in the past was $100.00. So, this Ordinance needs to be revised or a new Ordinance needs to be written and Bette suggested that the penalty be increased to $250.00 a cut. Richard Kerley made the motion to have this Ordinance 535 rewritten and to up the penalty to 250.00. Gary Pommier seconds the motion. The motion was approved.

NANCY FORBES, 313 S. PINE NO PARKING SIGN

Bette Lessen reported that Nancy lives on the corner next to Hookie ballpark. The cars that park during games is blocking her ability to get in or out of her driveway and would like to have some "No Parking" signs placed on the south side of her property. Richard Kerley made the motion to have the signs put up. Gary Pommier seconds the motion. The motion was approved.

LIBRARY- SWIM PASSES

Brenda Banks requested 50 pool passes for the library summer program. Gary Pommier made the motion to donate 50 pool passes. Richard Kerley seconds the motion. The motion was approved.

COUNCIL COMMENTS

Bob Lauck reported on Living Well meeting and on the safe sidewalk grant. Bob will be working with Brad Stroud.

Gary Pommier reported on the new excavator and how nice the trailer is. Plus, Nutter Electric and the Arma Auxiliary both donated $100.00 to the pool for free swims.

Richard Kerley asked about the moss that was a problem at Hookie pond last year.

Carma Burns reported on the upcoming Budget workshop that is set for either June or July this summer.

Vanessa Kent reported on the new debit/credit company Government Window working on a test site.

Tom Hays reported on June 22nd there will be a Justice class in Pittsburg at 10:00 am in the Courthouse on Locust St.

COMMUNICATIONS

None were present.

PURCHASE REQUEST

Richard Kerley made the motion to allow the purchase of the electric line covers for 114.00 per and getting 10 covers for 1,140.90. Gary Pommier seconds the motion. The motion was approved.

Bob Lauck made the motion to adjourn the meeting at 8:23. Gary Pommier seconds the motion. The motion was approved.
